Terms & Conditions

Company: The Fitted Furniture Company (Sole Trader)
Operating Areas: West Sussex, East Sussex, and Hampshire
Services Provided: Design, manufacture, and installation of bespoke fitted furniture for private homeowners.
1. Quotation and Pricing
1.1 All quotations are valid for 30 days from the date issued.
1.2 Prices are based on:
• Melamine finish: £2,000 per linear metre
• Bare MDF finish: £2,250 per linear metre
1.3 Any additional design requests or changes after deposit payment may incur charges of £30 per hour.
1.4 All materials and finishes are subject to availability. Minor variations in colour, texture, or finish are considered acceptable.
2. Payment Terms
2.1 Payment is divided into three stages:
• 30% deposit – confirms your order (non-refundable)
• 50% balance – due before materials are ordered (non-refundable once materials have been ordered)
• 20% final payment – due once the furniture has been fitted
2.2 Payment must be received in full at each stage before work progresses.
3. Retention of Ownership
3.1 All furniture remains the property of The Fitted Furniture Company until the final 20% payment has been received in full.
3.2 Until ownership transfers, the homeowner must not remove, sell, or damage the furniture.
4. Access and Site Conditions
4.1 The homeowner must provide safe, clear, and unobstructed access to the property and installation area.
4.2 The Fitted Furniture Company will not be responsible for delays or additional costs caused by inaccessible sites or unsuitable conditions.
4.3 The homeowner is responsible for moving existing furniture, protecting floors, and ensuring walls and ceilings are ready for installation.
5. Order and Lead Time
5.1 Standard lead time from order to installation is approximately 3 months.
5.2 Any design changes or schedule adjustments may affect lead times and incur additional charges.
5.3 The Fitted Furniture Company is not liable for delays caused by circumstances beyond its control, including material shortages, extreme weather, or third-party delays.
6. Cancellation and Refunds
6.1 The deposit is non-refundable under any circumstances.
6.2 Once materials have been ordered, the 50% balance is also non-refundable.
6.3 Cancellation requests must be made in writing. Any work carried out beyond deposit payment may incur additional charges.
6.4 The Fitted Furniture Company reserves the right to cancel the order at any time if:
a) The homeowner causes repeated or unreasonable delays that prevent progress;
b) The homeowner, or anyone acting on their behalf, behaves in a rude, aggressive, or abusive manner towards The Fitted Furniture Company or its representatives; or
c) The homeowner fails to provide safe and reasonable working conditions as outlined in Section 4.
6.5 In the event that TheFittedFurniture Company exercises its right to cancel under Clause 6.4, any non-refundable payments made up to that point will be retained to cover costs and lost time, and no further liability shall arise.
7. Installation and Property Damage
7.1 The Fitted Furniture Company will take all reasonable care during installation.
7.2 We are not liable for any property damage occurring during installation.
7.3 It is the homeowner’s responsibility to ensure the installation area is accessible and ready.
8. Warranty
8.1 All furniture is covered by a 12-month warranty from the date of installation, covering manufacturing defects only.
8.2 This warranty does not cover damage caused by misuse, negligence, normal wear and tear, or accidents.
9. Liability
9.1 The Fitted Furniture Company’s liability is limited to the repair or replacement of defective furniture under warranty.
9.2 We are not liable for indirect or consequential losses, including property damage, loss of income, or personal injury.
10. Intellectual Property
10.1 All designs, drawings, and plans remain the property of The Fitted Furniture Company unless otherwise agreed in writing.
10.2 Copying or reproducing designs without permission is prohibited.
10.3 The Fitted Furniture Company may photograph completed work for marketing unless the homeowner objects in writing prior to installation.
11. Governing Law
11.1 These Terms & Conditions are governed by the laws of England and Wales.
11.2 Any dispute should first be referred to mediation before legal action is taken.
11.3 If any clause is found unenforceable, the remaining clauses will remain valid.
By confirming a quotation, making a deposit, or proceeding with installation, the homeowner agrees to these Terms & Conditions.
